An appeal, under s44 of the Firearms Act 1968, against a decison of a Chief Officer of Police is to the Crown Court.
This is a complex area of law and we have the expertise to properly represent your interests in the preparation of your appeal. An appeal has to be considered on the merits and is not a review of a previous decison. Importantly, new evidence can be admitted which may not have been available at the time of the earlier decison.
In cases where an unreasonable condition has been imposed on the certificate then, whilst there is no appeal possible, the decison is subject to Judicial Review.
There is a right of appeal against the decisons of a Chief Officer of Police in connection with the grant, refusal, revocation or variation of firearms certificates. The appeal process also applies to the registration or removal from the register of firearms dealers.
